Which commercial pools Texas treats as public pools

Class C: apartments, hotels, clubs and HOAs

The state's definitions put a pool in Class C when it is limited to occupants, members or students and their guests rather than the general public: hotel, motel, apartment and condominium pools, property owners association and club pools, and school pools. A pool serving only a single-family home or duplex, used by no more than two resident families, is residential instead. Pools run by an association have their own page on HOA and community pool resurfacing.

The code behind a public-pool renovation

For commercial pools and spas, the state adopts the 2021 International Swimming Pool and Spa Code's chapters on public pools, public spas and aquatic recreation facilities, but not its residential chapters. Smaller work gets some leeway: the state lets a minor addition, alteration, renovation or repair to a pool that already exists keep to the construction standard in force when it was built. Local health authorities may set public-pool standards of their own only if they are equal to or stricter than the state's.

Finish color, slip resistance and cracks in a public pool

How light a public-pool finish must be

Under the 2021 International Swimming Pool and Spa Code, the edition Texas uses for public pools, the colors, patterns and finishes inside a non-residential pool or spa must not obscure objects or surfaces in the water, and the finish must reach at least 6.5 on the Munsell color value scale. The 2024 edition raises that minimum to 8.0 on the Munsell gray scale, and the 2027 edition asks for white or light-colored floors and walls, backed by the maker's test results. Waterline tiles, lane and step markings and pools shallower than 24 inches are exempt. The CDC's Model Aquatic Health Code also asks for white or light pastel floors and walls, so a swimmer on the bottom can be seen from the deck, though as a model code it isn't Texas law. Confirm which edition applies with the Town, and ask the finish maker for its Munsell value before a color is chosen.

Finishes made for commercial pools

NPT says natural quartz is ten times harder and more durable than marble, which is why it markets its QuartzScapes finish for commercial as well as residential pools. SGM's registered warranty on Diamond Brite runs 10 years on a residential pool but 5 on a commercial one, while its Diamond Brite Commercial White carries 10 years on both. Slip resistance and cracks

Surfaces inside a public pool or spa that people stand on must be slip resistant and must not cause injury in normal use, under the 2021 code. The Model Aquatic Health Code makes shell cracks part of the daily inspection and calls for repair once a crack changes enough to raise the risk of leaks, trips or falls, cuts, or trouble cleaning the pool; surface cracks under 1/8 inch wide are documented and watched for movement.

Anti-entrapment drain covers

Since one year after December 19, 2007, the federal Virginia Graeme Baker Act has required every public pool and spa in the country to have anti-entrapment drain covers that meet the federal standard. A public pool with a single main drain that isn't unblockable also needs a backup, such as a safety vacuum release system or an automatic pump shut-off. The Consumer Product Safety Commission recommends replacing any cover past the expiration date printed on it. Texas adds that a public pool's pump must not run while a drain grate or suction outlet cover is missing, broken or loose, and that documentation for every suction outlet stays on site or is produced within five business days of a regulator's request.

Depth markers and the shallow-to-deep line

Texas puts depth markers on a public pool's wall in the top 4-1/2 inches just under the coping, readable from in the water, with at least two per pool whatever its size. They must be permanent, with numbers and letters at least 4 inches tall in a color that contrasts with the deck and wall, spaced no more than 25 feet apart, and marked "feet" and "inches" or "FT" and "IN"; deck markers must also be slip resistant. A Class C pool deeper than 5 feet needs a permanent contrasting mark where the floor turns from shallow to deep, such as a row of floor tile at least 4 inches wide.

Closing, refilling and reopening a public pool

While the pool yard is closed

The state's operating rules treat a pool under renovation like any other closed pool: users and other unauthorized people stay out of the pool yard, the entry gates carry a sign saying the pool is closed, and the closed pool must not give off odors or breed insects. A pool-yard gate may be propped open only while an agent, employee or contractor of the owner is there doing work that reasonably needs it open. Around Class C pools, the enclosure stays at least 48 inches high from the ground outside, with no opening that passes a 4-inch sphere.

Emptying and refilling the pool

The Pool & Hot Tub Alliance tells public-pool operators to check that the hydrostatic relief valves work before emptying a pool, and to finish and refill it as quickly as possible. A public pool must stay closed while its water sits below the operating range of its rim, gutter or skimmer system. The Town was under its Long-Term Water Conservation Plan in October 2026; if Stage 2 of its emergency plan is declared, pools may be filled or refilled only between 6 p.m. and 10 a.m., and users of more than 10,000 gallons a month face a ten percent rate increase. Permits and the reopening inspection

If the work keeps a permitted public pool closed for 30 days or longer, the Town's article requires a pre-opening and pre-operational inspection before it reopens. The 2024 International Swimming Pool and Spa Code that the Town adopted says no permit is required for replastering or resurfacing an existing pool or spa, but the 2021 edition the state applies to public pools has no such sentence, and the Town's amended code still requires permits to alter or repair a pool. The 2010 ADA Standards don't say. An altered pool must have an accessible way in and out of the water, and remodeling and renovation count as alterations, but normal maintenance and painting don't unless they affect usability, and resurfacing isn't mentioned, so ask the authority. A community pool kept for residents and their guests is a different case: the Justice Department leaves it outside the ADA's accessibility requirements.

Does a commercial pool need a certified operator?

Yes. Under Texas rules, every Class A, B and C pool and spa, apartment and HOA pools included, is kept up under the supervision of an operator who is properly trained and certified. That operator doesn't have to be on site whenever the pool is open and may look after several pools. State law also sets minimum free chlorine at 1.0 part per million in public pools and 2.0 in public spas.
